The Role of the Court of Justice of the Andean Community in Regional Integration

On April 16, 2025, the FGV Jean Monnet Centre of Excellence on EU–South America Global Governance, co-funded by the European Union under the Erasmus+ Programme, in partnership with the FGV Centre for Global Law (CPDG), welcomed Dr. Gustavo García Brito for a guest lecture entitled The Role of the Court of Justice of the Andean Community in the Construction of a Regional Community of Law.


The lecture examined the contribution of the Court of Justice of the Andean Community (CJAC) to regional integration and the development of supranational legal governance in Latin America. In the first part of the session, Dr. García Brito introduced the institutional framework of the Andean Community, explaining its legal foundations under the Cartagena Agreement, the jurisdiction of the Court, the actors entitled to bring proceedings, and the interaction between the Community's institutions within the Andean legal order.


The second part of the lecture focused on the concept of a regional community of law, highlighting the role of supranational courts in promoting the rule of law, legal certainty, and the effectiveness of regional integration. Through the analysis of landmark decisions of the Court of Justice of the Andean Community, Dr. García Brito demonstrated how commercial and economic disputes are resolved based on principles such as legality, predictability, and effective judicial protection, thereby strengthening regional cooperation and facilitating free trade.


The lecture concluded with a critical reflection on the role of regional courts within the broader politics of international economic law, particularly during periods of political and economic uncertainty, when governments face competing domestic and regional pressures.
